The Alabama Supreme Court recently shocked the nation when it held that the word “child” includes frozen embryos. Treating an embryo as the equivalent of a child upends the fertility industry, as it threatens to end in vitro fertilization (IVF) services and puts the status of embryos already in storage in serious question.

While these implications are important to untangle, the brunt of the effects of fetal personhood will fall not upon families with the resources to undergo IVF, but rather on poor and non-white women. Every decision made by a pregnant person could be second-guessed by the government. Every step outside of the most risk-averse approach to pregnancy puts the pregnant person under the microscope of the state.

Healthcare Across Borders: Funding Telemedicine Abortion for People in Abortion-Ban States

“You can get on the phone with a doctor, and get abortion pills by mail within a few days,” said Healthcare Across Borders (HCAB) founder Jodi Jacobson—even in states with abortion bans.

HCAB has launched a new Abortion Pill Sustainability Fund to support shield-state clinicians serving patients in states banning abortion. Abortion services are provided to people located in states banning abortion from the six states with telemedicine provider shield laws: Massachusetts, Washington, Colorado, Vermont, New York and California.

The Anti-Abortion Movement Is Coming for Fertility Treatments

The availability of in-vitro fertilization in Alabama may now be in question after the state’s Supreme Court ruled that embryos kept in clinic freezers are considered persons under the law, and protected by the state’s Wrongful Death of a Minor Act. It’s a shocking and jarring decision that radically extends the bounds of legal personhood, tosses any claims to originalism aside, and seems primed to make a variety of fertility treatments either extremely costly for patients, or extremely legally risky for clinicians.

IVF is, unfortunately, not safe from the anti-abortion movement. Many of the movement’s leaders have indicated that they would like to outlaw it, and while right now they have bigger fish to fry, abortion opponents have never stopped at simply (“simply”) banning abortion. They want full control over reproduction, and over women specifically. And Alabama just put us all one step closer to their ultimate goal.
