In April, the nation’s highest Court will hear a pair of cases that will determine whether the Emergency Medical Treatment and Labor Act (EMTALA) preempts state laws that impede emergency abortions needed to protect the health of pregnant people even if they are not on the brink of death.

As physicians, we can follow neither our ethics nor appropriate standard of care if uninformed politicians flagrantly disrespect our training. If they can undermine our careful decision-making with brute force and no medical qualifications, then what is the point of our expertise?

This is all grotesque and radically out of line with what we would expect of a reasonable advanced and humane society, but it’s not surprising: It’s exactly what happens when the theocratic, fundamentalist “pro-life” movement seizes power.

Supreme Court Hands Antiabortion Crisis Pregnancy Center a Procedural Win

On Dec. 2, the U.S. Supreme Court heard oral arguments in First Choice Women’s Resource Centers v. Platkin, an unregulated pregnancy clinic’s constitutional challenge to the New Jersey attorney general’s subpoena for information about its operations, including donor records. 

Despite being awash in revenue, and serial reports of fraud, waste and illegal use of taxpayer funds, these antiabortion clinics are positioning to realize a long-term goal: to “replace” Planned Parenthood and Title X programs and secure federal taxpayer funds to advance an agenda that promotes childbirth and undermines evidence-based healthcare. 

As right-wing politicians decimate the reproductive health delivery system for low-income and uninsured Americans, the UPC industry is ramping up the narrative that their unregulated pregnancy clinics are the answer to the maternal healthcare deserts their policies have created. 

Most media observers are predicting the Court will rule for the crisis pregnancy center, First Choice. If it does, unregulated pregnancy clinics nationwide will be further emboldened to resist any state oversight, including of their medical services. A bold, innovative, multi-front action by reproductive justice advocates, public health professionals and pro-choice officials is the only way we ensure they can’t succeed.

UPDATE: In a unanimous 9-0 decision, the U.S. Supreme Court ruled in favor of the antiabortion pregnancy center at the center of this case, reversing the Third Circuit Court of Appeals’ prior decision and allowing the organization to challenge a New Jersey subpoena in federal court. The Court did not rule on the merits of the subpoena itself, but held that the pregnancy center had standing to bring its constitutional challenge in federal court, rejecting lower court findings that the dispute was premature.

Blueprint for Nationwide Abortion Pill Crackdown Falters in Texas

In Texas, the state Senate just opened yet another door to women being criminally prosecuted for obtaining an abortion … even in a different state. Authored by Sen. Bryan Hughes, Senate Bill 2880—titled the “Women and Child Protection Act”—just passed in the Senate. It ushers in a currently dormant 1925 abortion ban and would be the first law in the country to allow pregnant women to be prosecuted for receiving abortion care.

“The most egregious point of SB 2880 is that it quietly revives Texas’ pre-Roe abortion ban by explicitly incorporating the 1925 law into the bill’s definition of criminal abortion law,” said Sen. Carol Alvarado, a Houston Democrat.

The people in power in Texas forced me to give birth with their abortion ban. I wanted everyone to know who Halo was and how she suffered.

“We all try to visit Halo’s grave every Sunday, and we’ll have a party for her second birthday on March 29 with a cake. We call her birthday her ‘Freedom Day.’ The day she was born is the day she was finally free to go to heaven. She shouldn’t have been on this earth, but the state of Texas forced her to be here, and she fought a fight we all knew she would lose.”
